  1. USER INFORMATION 

Who is responsible for the processing of your personal data?

DACOR FORMACIÓN DEL MAR SL, hereinafter referred to as the CONTROLLER, is responsible for the processing of personal data collected through this website from the USER and inform you that these data will be processed in accordance with the provisions of Regulation (EU) 2016/679, of 27 April General Data Protection (GDPR), and Organic Law 3/2018, of December 5, Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD).

What do we use your personal data for?

We process personal data for the following purposes:

  • Clients: We manage the minimum data necessary to execute the contractual relationship and provide the contracted services. In cases where the provision of our services requires access to the personal data of our clients (e.g., signingdata processing contracts), we strictly comply with current regulations.
  • Suppliers: We manage the data for the purpose of executing the commercial/professional relationship with our suppliers.
  • Clients, Contacts: We send commercial advertising communications via    email, fax, SMS, MMS, social networks, or any other electronic or physical means, present or future, that allows for commercial communications. These communications will be made by the CONTROLLER and will be related to its products and services, or those of its collaborators or suppliers, with whom it has reached a promotional agreement. In this case, third parties will never have access to personal data.
  • Candidates: If you send us a resume (CV), we will retain it to manage your potential candidacy within our organization. 
  • Ethics channel: We manage data (of any nature) received through the Ethics Channel solely to handle received complaints and conduct the corresponding investigation based on the services contracted by our clients. 

What type of data do we process? (Data categories) 

Depending on the service and purpose, we will collect different types of data. Generally, we only collect identifying and professional data (name, surname, email, telephone number, position in the company, and company information).

Why can we process your personal data? 

Because the processing is legitimized by Article 6 of the GDPR as follows:

  • With the USER’s consent: sending commercial communications and newsletters
  • To execute the contractual relationship that the USER establishes with the CONTROLLER: clients, suppliers, employees.
  • For the legitimate interest of the CONTROLLER: conducting market studies, statistical analysis, etc., and handling orders, requests, etc., at the USER’s request.
  • Regarding the management of the whistleblowing channel, the legal basis for data processing will be to fulfill a mission carried out in the public interest or to comply with a legal obligation, depending on the specific cases and the type of company to which the services are provided.

How long will we keep your personal data? 

We will retain your data for no longer than necessary to maintain the purpose of processing or as long as there are legal requirements dictating their custody for a specified period. Once they are no longer needed for that purpose, they will be deleted with appropriate security measures to ensure the data is anonymized or completely destroyed

Who do we share your personal data with? 

No personal data will be communicated to third parties unless it is necessary for the development and execution of the purposes of the processing. In such cases, data may be shared with our service providers, with whom the CONTROLLER has signed confidentiality and data processing agreements as required by current privacy regulations.

If any of these providers are located outside the European Union, we have ensured that they comply with the appropriate safeguards as stipulated by the GDPR.

What are your rights?

The USER has the following rights: 

  • Right to withdraw consent at any time when consent is the basis for the processing. 
  • Right of access, rectification, portability and deletion of your data, and the right to limit or oppose its processing.
  • Right to file a complaint with the supervisory authority (www.aepd.es) if you believe that the processing does not comply with current regulations.

  1. MANDATORY OR OPTIONAL INFORMATION PROVIDED BY THE USER 

By checking the corresponding boxes and entering data in the fields marked with an asterisk (*) in the contact form or presented in download forms, USERS expressly, freely, and unequivocally accept that their data is necessary for the provider to fulfil their request, with the inclusion of data in the remaining fields being voluntary. The USER guarantees that the personal data provided to the CONTROLLER is truthful and is responsible for communicating any changes to them.

The CONTROLLER informs that all the data requested through the website is mandatory, as it is necessary to provide an optimal service to the USER. If all the data is not provided, it cannot be guaranteed that the information and services provided will be completely tailored to your needs.

  1. SECURITY MEASURES 

In compliance with the current regulations on the protection of personal data, the CONTROLLER adheres to all provisions of the General Data Protection Regulation (GDPR) and the LOPDGDD for the processing of personal data under its responsibility. This includes explicit adherence to the principles described in Article 5 of the GDPR, ensuring that data is processed lawfully, fairly, and transparently, in relation to the data subject, and that it is adequate, relevant, and limited to what is necessary for the purposes for which it is processed.

The CONTROLLER guarantees that it has implemented appropriate technical and organizational policies to apply the security measures established by the GDPR and the LOPDGDD in order to protect the rights and freedoms of the USERS. Additionally, the CONTROLLER has communicated the appropriate information to the USERS so that they can exercise their rights.
